Backer Rewards and DRM-Free Copy

Seeing how many other developers sell their games on GOG and Humble at the same time, I honestly doubt GOG would ask for exclusive deal. The deal was most likely about Galaxy integration (Achievements and other features) than anything else.

Same for me, it doesn’t matter in the end where the game will end up,looking forward to finally play it :slight_smile: just a matter of time now.

That something does not exist cannot be proven. I cannot prove to you that aliens do not exist, you will just say we have not found them yet. Same here, you can just claim he is withholding information that would show a relation.

Proving existence is easy however, all you have to do is find one alien.

So the burden of proof is on you here. If he says he has no relation to Crate then there is no reason to doubt that. If you do, then prove that relation, he cannot prove that there is none.

Btw, assuming that everyone who does not share your view has to be an ‘ally’ of ‘your enemy’ (has to have some kind of relationship with Crate, apart from possibly being a customer) is borderline paranoid…

Don’t get me wrong. I think the request is ridiculous, but a mirror pic with a photo ID could then be compared to the Crate team.

which at best proves that he is not part of the team, not that he has no relation to Crate at all (best buddy with medierra). If you believe the pic is genuine in the first place.

We know who works for Crate and their IDs here. I don’t think anyone has to prove that he is not an employee using a different user name… that just goes too far into tinfoil hat territory. There is not even any reason to hide the identity in the first place…

There’s no reason for endless debate in this thread. If you’re not upset about the situation, we appreciate your understanding. Others are angry and will no doubt continue to be so - having people argue with them is unlikely to improve their situation or ours.

So I’m taking it from the lack of announcements that no humble version is coming out anytime soon. Still seems simplest to remove steamworks and set out the current build to backers while GOG does their thing.

What I find baffling in this situation is that knowing their backing status (way over the baseline sell price, 1 for sure another perhaps) or the way the express some of their more rational thoughts (3 of them or more)… some of the bashers of affected people in this thread are not children or a teenager and that makes me go facepalm

OK. One guy said delete posts and keep only lead dev’s input. Like if silencing a minority that is wronged wouldn’t make them go berserk.
Another said something along “gosh this thread is over 29 pages of going back and forth” now me for example I have 3 or 4 posts in this thread while this guy has 5x times more or hell maybe it goes exponential by tomorrow there’s no need for a definite number… and he makes that XD dayum 29 pages!!! post. I mean… WOW!

Now how come I only got a few single digits post. I did not participate at first even if what happened and the explanations given did completely burry the creative entity known as Crate for me as of now (well then) and for the future. But the constant unfounded assault, trolling, and ridicule thrown and A LOT of just plain ignorant things that a 15 year old teen with moderately below average intellect would agree with and just go rofl at some guys that not only have a personal and deserved point of view BUT a LEGAL one as well in this mess and the fact that this was tolerated by the website administrator(s) moderator(s) was why well I’m here.

This is one way it could’ve been handled: ALL posts before stay untouched then a reputable moderator (I think Zantai maybe) after consulting with the lead dev. at least, makes a post saying that from now on, people posting in this thread and NOT affected by this matter (affected NEGATIVELY) that, by the way, do so mostly to berate, slander, aggravate etc. well they’d be deleting their post, giving them a forum vacation or whatever. It hasn’t been done and it’s to late too do it now or they’d look like fools.

Now for the legal aspect, friends. So Crate has offered no public refund procedure to those affected by the situation.
It has been well explained and hinted in a massive post above that in the kickstarter avenue there is no legal way to win whatsoever right now in the USA where KS and the project are based (well hell even worldwide I guess). However, there was a way to buy the product after the KS and it was advertised and proposed on this website through whatever other partner which is of no concern.

Now the way to win this in real BASIC terms for the backers too is: The angle of attack to have things settled JUSTLY is the baseline product that was offered after the KS, the cheapest one. There is no way they can defend and win based on the facts, the terms, the capital it would cost them to execute such a defense, and they dug themselves in with the reasons they provided. Then the buyers and thus backers would be entitled to a refund of the base price only based on the fact they be considered as “investors” or we’d find another term/way anyway (this could be a precedent and help others in other cases however it will be a long procedure and Crate would be K.O. probably way before any semblance of decision is judged hell even before the case presented) so they lost the money the gave away to support the Crate entity (this can’t be recovered with the laws in place right now or it’s like 99.5% chance to lose). Then we take the money and we refund everyone together by their real contribution vs base price (a guy that paid 150 USD let’s say base price was 24.99$ he’d be paid X% more than the guys that didn’t do the KS or that did the KS at a lower price point. (everyone receives a bit less of their
total contribution but it is fair to all) Now this step is optional but I’d do it because we obviously aren’t assholes.

Someone said something some pages ago like: OK but where is my compensation for this mess beyond the $$$ product price because well give them a lesson for that shady way to handle legitimate business? Then a Smart fanboy or whoever (why do they do this??? It is irrational, they hurting their idol/master with their dumbness???) was quick to say lolol really child hahaha compenfuknsention WOW can’t type guys it too funny I got tear!! or something like that.

100 years ago this wasn’t needed but today with all the RL trolling it is. If you can you get a family lawyer. Mine is based in NY city. It is professional of course but he also visit your estate, house or place he knows your family you know his. You do not have another lawyer and you don’t deal with another cabinet you don’t break that link, that trust tie. You pay him as insurance even when nothing is happening (hopefully most of the time :wink: ). Now what I do in most cases for the compensation additional stuff penalty call it wtv, is I give it to charity and it is specified, thus I’m kinda trolling the losers that tried to screw me too and well what they gonna say? That I’m enriching myself on their “misfortune”? They can’t! One time a somehow large corporation that I VSed with well they lost they paid but the judge ordered a complementary compensation that we’d said would go to a charity if awarded and it was like ASTRONOMIC usually this is something you appeal but it was awkward to appeal as it was going to injured wolves and some other animals or grown in captivity (can’t release or the Alpha wolfs would bully them to death in nature 100% they dead). So the judge trolled them too, that will teach them :). When I visited the place for formalities (I went cause I wanted to see the place) there was one guy his wife and three employees. The wolf the deer had small places to play and the wolves were friendly with the owner like he went inside and played with them. I went back like 3 years after to see what’s up for fun. The guy bought the whole forest around and the wolf playground is now bigger than an NFL stadium.

If in 3 or 4 days Crate receives the documents my lawyer would prepare for this case (including request if going for trial for extra $$$ for a charity (id select one close to where they operate for extra oumph) (this can’t be done everywhere though depends the State or jurisdiction and other legal details) with a proposition for immediate settlement to all that would signal themselves that I don’t think they can afford to pay. Well they will need a TEAM of counselors or lawyers just to evaluate the situation they are in,
NOT A LOL CHILD PLAY guys grow up, guy install the Steam u pathetic scrubs etc. this won’t work anymore boys. They are de-facto just by reading the first 5 pages went it arrives at the office. In the CRAZY situation they go to trial defending against it they will be destroyed no competent or established cabinet will even take their case after reviewing the facts hell just reading the declarations they’d go damn I suggest negotiating a settlement and by taking our most optimistic suggestion well you’re bankrupt or worse…

THE ONLY reason I take the slap and don’t go ahead with whatever against Crate (and thus the bull**** that’s happening in this digital funding emerging industry) is not because you trolls or idiots are calling us entitled and I’m scurred we don’t have a case as revealed by the smart geniuses slandering around here, it is because when I play GD Ill probably play 1K hours +. When this project was announced I looked at the lead dev. and well was convinced he wouldn’t be able to bring his project his passion his dream to reality. I mean TL2 had the D. devs had an OK staffed team financing etc. and well to me TL2 was so flawed so not engulfing in its setting etc. that I was wow this
guy thinks he can deliver!!!??? He got the spirit I give him that but it can’t be done! And now OMG he and his team did something incredible, that’s how I view it (from a creation point of view, besides CRATE has lost much (all?) credibility to me and others or hell any business analyst or even incompetent investor would be like wtf happened here? Did you guys think about the broader range of your decisions?? Now I don’t play many games. What would I do without Grim Dawn? How the hell am I gonna get the expansion if the studio collapses!!?? Now if a new fanboy has managed to read up to down here, I graciously recommend reading some previous posts if you got the caliber for it, you might understand that the trollin you’d like to contribute isn’t favorable to who you’re a blind lovin fan of.

There are hundreds of games that were funded and not delivered on and you just wrote a book threatening legal action over having to wait a week or two after initial release for your DRM free copy. There’s a zero percent chance that would hold up in court. Send your letter.

Like what do you want crate to do? Refund your order? Email them! Email humble bundle! I assure you you’ll get your refund through those avenues.

Go ahead and dismiss my concerns as trolling without a second thought, but giant stories about someone’s estate have no relevance at all to this case. Did Crate drop the ball on release? Yeah, I think so. Does that mean you can get a refund? Probably. If you don’t want a refund, however, please be constructive on this thread instead of posting vitrol just to stir something up.

If people continue to make inflammatory posts aimed at one group of users or another, in what is devolving into a flame war over the DRM-Free release issue, they will be deleted.

If you want to continue to rage out about it and direct your posts at Crate, go for it. All this thread should be at this point is people directing questions or comments at Crate, not against one another.

If people have not yet claimed their Steam key from Humble Store and would like a refund over this DRM-Free release delay, email support with your KS backer info and we can issue a refund via PayPal.

Edit - Lol, just read the previous post about legal action. Given that we never made any guarantee of concurrent release, have made efforts toward the DRM-Free release and are talking about a 1-2 week delay, good luck if you want to take it to court. Not sure why everything seems to come down to threats of legal action these days but whatever… In any case, I’m happy to offer a refund if that’s what you need.

I think a lot of the upset people are wondering if GoG will get the same attention to detail with patches that the Steam version will.

How will you handle content updates, balance patches, etc? will the GoG installer be brought up to date with each pass? Will we be able to play with friends over the internet, or just LAN?

GoG will receive the same updates as Steam - it’s part of the reason we’re going with that delivery option. They seem to have a better system for delivering that than Humble. Getting GD working on the GoG Galaxy multiplayer system was a big part of the work involved in preparing the build for GoG. By signing with them, we were contractually obligated to implement Galaxy features, provide updates as released on Steam and potentially implement future features to ensure parity with Steam. If we’d just gone the Humble route, we could have pooped out a DRM-Free build without doing any of that work, so we’re at least trying to provide the best solution for people.

As for why we aren’t pushing out a build via Humble in the meantime, one of the conditions for distributing GoG keys to backers is that they can’t also have the option to download another DRM-Free build out of concern that people might then sell the GoG keys. It’s not my concern but it’s a condition we’re bound to. We’d also end up with 3 different builds in existence and, inevitably, I’m sure there would be people who wanted to keep using the Humble build and would be upset if we didn’t then support it also with it’s own updater and mp match-making. I don’t think it makes sense to create an extra build over what should only be a difference of about a week between the time it would take us to get one out vs. the other.

My first post here, just wanting to say that I’m looking forward to the GoG release. I don’t think ‘Steam is evil’ by any means, but given the choice I’d go with GoG every single time, even over Humble.

I won’t pretend I’m not disappointed in the delay, but I imagine many of us who Kickstarted it way back when are appreciative of both the frequency and candidness of the updates regarding the whole situation. I do hope the bumps preventing a timely initial release on GoG don’t also lead to delayed patches and updates down the road compared to other platforms, but for now, I’m just glad Grim Dawn is finally about to arrive. :slight_smile:

Thanks, hopefully there can be some news in weeks time, I’ve really trying to avoid the arguments here recently but people keep inflaming things on both sides when with increasingly tenuous arguments, and the posts you make render most of that moot. Thanks for the information, looking forward to finally playing.

P.S. Galaxy is the one thing that I dislike about GOG lol, sorry they pulled it as part of the deal. Guess it’s a necessary evil in their view to keep up with some steam features.

Would highly suggest that this post goes into a FAQ or something; it explains very well why you can’t just upload the binary to GoG and call it done.

i’m in the same boat as you with Galaxy, but it may be optional like it was for Witcher 3, except for multiplayer perhaps. let’s wait and see !

Galaxy offers a crossplay feature, which means we’ll (most likely) be able to play with each other regardless of what build we’re using :slight_smile:
